Terms & Conditions

All prices are based on tariffs and exchange rates current at the time of quotation and may be subject to change. Artist will pay Oktopus Music Studio a deposit of 50% of the estimated total charges at the time of booking, and the balance due on arrival. Studio time or any other services will not be reserved until the deposit is paid.
All payments to be made in £ Sterling to be drawn on a UK bank or transferred directly to Oktopus Music account.

Artist agrees to pay for the Services at the applicable rates set out on the agreement.
The customer is responsible for a timely start of the session and will be billed according to the arrangements made herein. Upon completion of the session the customer is responsible for payment of the balance due and the applicable tax. If no down payment has been made, Oktopus is not responsible for assuring the availability of the studio premises or an engineer. If the session goes into overtime, the customer is billed according to the studio's regular hourly rate (30 min. increments).

Responsibilities of Oktopus Music Studio
1. Oktopus Studio agrees that it will provide the equipment in good working order; at Artist's request, provide studio personnel to assist as required during Artist's session; maintain safe, clean and comfortable facilities and ensure Artist's privacy during sessions.
2. Studio shall not be liable for any failure to perform its obligations if such failure is due to circumstances beyond its reasonable control. Any liability of Oktopus Music Studio shall be limited to the total of all amounts paid by Artist for Services under the Agreement.

Responsibilities of Artist
Artist agrees that it will make all payments when due; pay all contract musicians directly; pay for any damage caused by Artist or by Artist's personnel or guests, other than normal wear and tear, to the equipment, studio facilities, common areas, building or grounds; not eat, drink, or smoke in the control room and not place any food, drinks or smoking material on any equipment; and not bring into or be under the influence of any illegal controlled substance or alcoholic beverage; respect the neighbors and neighborhood surrounding the facility.

Cancellation Policy
All cancellations must be notified immediately in writing to Oktopus Music Services Ltd and will incur the following charge:
a)Cancellations notified with 5 working days prior to arrival will incur a 50% cancellation charge
b)If you cancel your session on the same day, or without giving the studio Advance Notice Time, the deposit or pre-payment will be used to cover the cancellation cost and therefore cannot be used to confirm another session.
c)The studio reserves the right to give time you requested to someone else, if your session has not been confirmed with a deposit or full payment
d)In the event of services becoming unavailable, notification will immediately be given to Oktopus Music Services Ltd, and an alternative of similar quality will be supplied.

Customer Service
a)Oktopus Music Services operate a Customer Service Charter to deliver excellence at all times. In the unlikely event of a customer being dissatisfied with any part of our service, Oktopus Music Services Ltd agrees to take action to ensure that any complaint lodged by a client is rectified where possible.
b)Artist understands that there will be additional fees for any additional services not listed on the agreement that are provided by Studio at Artist's request.
c)The Company reserves the right in its absolute discretion to refuse to offer its services any person whose conduct or manner causes or is likely to cause offence or upset to Oktopus Music Services Staff and Team. In such cases full cancellation charges will apply and the Company shall have no further liability to that person.

Loss or Damage
Oktopus Music Services may not be held responsible in any way for injury, damage, loss.
1.Oktopus Studio shall use reasonable efforts to secure all recording media (all master tapes, slaves, final mixes, DATs, cassettes, and all other magnetic media storage devices) belonging to the Artist and stored on the studio premises, but Studio shall not be liable for loss of or damage to any of the above.
2.In the event of loss to or damage of Artist's recording media due to willful negligence, Oktopus Studio shall be responsible for replacement of no more than the value of the total replacement cost of the unrecorded tape and studio time to date devoted to said recording media.
3.Artist is solely responsible for all personal property belonging to Artist, Artist's employees and guests. Studio shall not be liable for any loss of or damage to any of such personal property.
4.Artist shall be responsible for any loss or damage to Studio property caused by Artist, Artist's employees, guests, invitees or agents acting under Artist's instruction, as a result of misuse, negligence, carelessness or willful misconduct.

"Force Majeure"
In the event of circumstances amounting to "Force Majeure" including war or threat of war, civil strife, riot, natural or nuclear disaster, fire, epidemics, terrorist activity (threatened or actual), acts of God and all similar events outside Oktopus Music Services' control which prevent or seriously impede Oktopus Music Services from carrying out its scheduled programme, Oktopus Music Services shall be entitled at any time on giving written notice to the agent to terminate or suspend or alter the operation of the agreement.
